3. Website Terms of Use and Operational Control

The information, text layouts, pricing structures, and product availabilities displayed on this website may contain technical updates or minor errors and are subject to change or revision without prior notice. CANAwhite Inc. / CANAblanc Inc. retains the absolute operational right to refuse manufacturing services, close user accounts, or cancel processing orders at its sole discretion. This right will be exercised if a user’s behavior violates local regulations, compromises our production staff, or undermines the commercial interests of the company and its subsidiaries.

4. Privacy, Protection, and Digital Asset Management

We operate a secure data protocol to protect the personal information and digital assets of our customers. All user contact details and uploaded digital 3D-scanning data (including STL files) are processed strictly for the internal engineering and fabrication of your ordered consumer products. This information remains proprietary to CANAwhite Inc. / CANAblanc Inc., is protected within our private digital infrastructure, and will never be shared, sold, or distributed to external marketing networks.

5. Brand Identity and Trademarks

All commercial logos, product titles, custom taglines, and brand identifiers displayed on this platform are the trademarks of CANAwhite Inc. / CANAblanc Inc. or their respective third-party suppliers. No user is granted any implicit or explicit right to copy, replicate, or commercially distribute the brand trademarks or text layouts hosted on this site.

6. Domestic Canada Post Shipping Rules

CANAwhite Inc. / CANAblanc Inc. processes and ships all customer orders strictly within Canadian domestic borders. All shipments are fulfilled using Canada Post. The legal ownership and risk of product damage or loss transfer fully to the buyer the exact moment the package is securely scanned and handed over to Canada Post.

7. Global Shipping and Customs Limitations

Should our distribution network expand internationally, the recipient assumes full financial and legal responsibility for any unexpected customs tariffs, border handling fees, or import duties applied at the destination country. Shipping regulations vary heavily across international borders. It remains the buyer's sole responsibility to verify that their country permits the legal import of custom polymer items. CANAwhite Inc. / CANAblanc Inc. is not responsible for any confiscations or penalties resulting from improper international shipping.

8. Provincial Sales Tax Application

All sales transactions processed through this platform are subject to applicable provincial taxes, which are calculated based on the business tax rates of the Province of Alberta and the specific Canadian destination to which the final order is being shipped.

9. Customer Agreement to the DIY Impression Process

By completing a purchase, the customer explicitly acknowledges that they are buying a direct-to-consumer, self-administered product kit. The customer assumes 100% of the responsibility for mixing the impression compounds, placing the tray into their own mouth, and following the provided instructions to create their own physical dental mould.
The customer warrants that their teeth are structurally stable, and they certify that they do not suffer from untreated periodontal disease, raw oral wounds, unseated crowns, or loose orthodontic hardware that could be dislodged during this self-guided mould process. The sole role of CANAwhite Inc. / CANAblanc Inc. is to act as a custom manufacturing facility that digitally scans your provided impression, 3D prints the structural model, thermoforms the materials, and delivers the final consumer good back to you.

10. Product Specifications and Intended Use

The customer agrees that all goods manufactured or sold by CANAwhite Inc. / CANAblanc Inc.—including custom teeth whitening trays, sports mouthguards, cosmetic whitening gels, and topical whitening pens—are designed purely as athletic protective wear or cosmetic enhancement aids.
The customer understands that these items are not medical devices, are not orthodontic retainers, and are not nightguards for treating jaw conditions. They are not designed or marketed to correct dental relapse, treat severe nightly teeth grinding (bruxism), alleviate TMJ/TMD disorders, or treat sleep apnea.

11. Complete Limitation of Liability

To the fullest extent permitted by applicable Canadian law, CANAwhite Inc. / CANAblanc Inc., its directors, owners, and operators assume no financial or legal liability for any direct, indirect, incidental, special, or consequential bodily injuries or damages resulting from the use or misuse of our self-impression kits, topical whitening formulations, or custom polymer products.
This absolute waiver covers, without limitation, any unexpected dental injuries, tooth movement, jaw alignment changes, choking hazards, heightened tooth sensitivity, tissue burns, allergic reactions, uneven cosmetic shading, or any other issues arising from a failure to follow product instructions or from using the products with pre-existing oral health problems.

12. Topical Whitening Gel and Pen Safety Rules

By utilizing our topical whitening gels or whitening pens, the customer certifies that they understand these are standard, over-the-counter cosmetic formulations. CANAwhite Inc. / CANAblanc Inc. warrants that all provided gels and formulations strictly adhere to Health Canada's Cosmetic Regulations, maintaining an alkaline/neutral pH balance greater than or equal to 4.0 to guarantee enamel safety.
The customer assumes full responsibility for checking the ingredients for personal allergens and for following all guidelines to prevent swallowing or soft tissue contact. Temporary tooth sensitivity or minor surface irritation can occur during cosmetic whitening. The customer agrees to stop using the product immediately and consult a professional if they experience severe, persistent, or unexpected pain or swelling. Whitening products should never be applied to teeth with untreated cavities, exposed roots, or damaged enamel.

13. Eligibility and Age Restrictions

The Customer acknowledges and agrees that the products manufactured by the Company are strictly not suitable for, nor intended for use by, individuals under twelve (12) years of age.
By completing a purchase, the Customer certifies that they are eighteen (18) years of age or older. If any custom surface guard, cosmetic whitening kit, or topical accessory is purchased for use by a minor aged twelve (12) or older, the Customer certifies that they are the parent or legal guardian of that minor, and they explicitly execute this legal waiver and assumption of risk on the minor’s behalf.

14. Proprietary Content Notice

All original text, website layouts, product descriptions, photography, digital interfaces, and custom graphical materials featured on this platform are the exclusive intellectual and commercial property of CANAwhite Inc. / CANAblanc Inc. 15. Governing Law and Jurisdiction

These Terms and Conditions, along with any commercial transactions or legal disputes arising from the use of this website or our custom products, shall be governed by and construed exclusively in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. The customer explicitly agrees that any legal mediation, arbitration, or court proceedings shall be filed and conducted exclusively within the city of Grande Prairie, Alberta, Canada.

16. Severability of Provisions

If any specific section, clause, sentence, or provision of these Terms and Conditions is determined by a court of competent jurisdiction to be invalid, illegal, or legally unenforceable under applicable provincial or federal laws, such a ruling shall affect only that isolated provision. The remaining sections of this agreement shall continue to be fully valid, operational, and legally binding upon both parties.

17. Unforeseen Operational Disruptions (Force Majeure)

CANAwhite Inc. / CANAblanc Inc. and its operators shall not be held legally responsible or financially liable for any failure, delay, or interruption in manufacturing, processing, or shipping your order if such delay is caused by circumstances entirely beyond our reasonable corporate control.
These events include, but are not limited to: nationwide or regional postal strikes, shipping carrier logjams, supply chain materials shortages, power grid gridlocks, manufacturing machinery failures, local regulatory updates, or natural severe weather events. In the event of an unforeseen operational disruption, the Company reserves the right to extend production timelines or pause shipping cycles until regular commercial operations can safely resume.
